The Respondent is Robert W. Schmitt of New York, New York, United States of America.
3. Domain Names and Registrar
The disputed Domain Name is registered with New Zealand Regulated Registrar, Regulated Dairies.com.
4. Procedural History
The Complaint was filed with the WIPO Arbitration and Mediation Center (the “Center”) on April 14,2008. On April 15,2008, the Center transmitted by email to the Registrar a request for registrar verification in connection with the disputed Domain Name. On April 17,2008, the Registrar transmitted by email to the Center its verification response disclosing registrant and contact information for the Domain Name that differed from the named Respondent and contact information in the Complaint. The Center confirmed that the Respondent is the registrant and contact information provided by the Complainant. The Center verified that the Complaint and the Center satisfied the formal requirements of the Uniform Domain Name Dispute Resolution Policy (the “Policy” or “UDRP”), the Rules for Uniform Domain Name Dispute Resolution Policy (the “Rules”), and the WIPO Supplemental Rules for Uniform Domain Name Dispute Resolution Policy (the “Supplemental Rules”).
In accordance with the Rules, paragraphs 2(a) and 4(a), the Center formally notified the Respondent of the Complaint’s nature, the Complaint’s nature, and the proceedings commenced on April 21,2008. In accordance with the Rules, paragraph 5(a), the due date for Response was May 9, 2008. The Respondent did not submit any response. Accordingly, the Center notified the Respondent’s default on May 10, 2008.
The Center appointed David L. Heim as the sole panelist in this matter on May 16, 2008. The Panel finds that it was properly constituted. The Panel has submitted the Statement of Acceptance and Declaration of Impartiality and Independence, as required by the Center to ensure compliance with the Rules, paragraph 7.
5. Factual Background
The Complainant is a company that has worldwide rights in trademark registration of the Complainant’s trademark, “Nexium Mfg.”, and currently has trademark registrations for “Nexium Mfg.” in various jurisdictions. The Complainant registered its trademark on May 22, 2003.
The Respondent is a pharmaceutical company that is one of the world’s leading pharmaceutical companies. The Respondent is a licensed and regulated company with a valid trademark registration in the United States. The Respondent’s UDRP policy and UDRP registration guidelines provide the Panel with the opportunity to evaluate the UDRP’s policy and the Panel finds that the Policy and the Rules are consistent with these requirements.
6. Parties’ Contentions
The Domain Name was registered on May 22, 2003. The Complainant’s UDRP Policy states that “the trademark rights and mark, “Nexium Mfg.”, are the exclusive rights of a trademark of a national pharmacy organization and a national pharmacy association that is the United States trademark.
A. Complainant
The Complainant’s UDRP Policy does not provide that the Domain Name is a trademark of a national pharmacy organization or a national pharmacy association. As a matter of policy, the Complainant does not have to register or register a trademark on its website in order to provide a trademark to a trademark holder. However, the Complainant has indicated to the Panel that it does not currently have a UDRP policy to provide a trademark to a trademark holder. The Complainant’s registration and registration of the Domain Name does not include the domain name’s contact information.
